Delivery and Return Policies

  • Upon placing an order, the buyer is obliged to familiarize themselves with the following delivery conditions.

     

    (1) General

    The Buyer’s acceptance of the order includes the acceptance of these terms and conditions. We reserve the right to change prices quoted as a result of changes in exchange rates, customs or tax rates or other reservations beyond our control until the invoice date.

    (2) Delivery

    For all deliveries, a shipping surcharge of net invoice amount is calculated as follows:

    Sone 1 – Eastern Norway ……………………………………………. 3,0 %
    Sone 2 – Southern Norway …………………………………………. 3,5 %
    Sone 3 – Western and Central Norway ………………………… 4,0 %
    Sone 4 – Northern Norway …………………………………………. 6,0 %

    Additionally, transport insurance is charged at 0.5%.

    A minimum sum is charged in total for freight surcharges and transport insurance denominated at NOK 350. For deliveries of masts and foundations, packaging and shipping costs are charged. This also applies if the need and use of a crane truck is agreed upon.

    The environmental fee is charged at the current rates of the net invoice amount. The amount is specified on the invoice. This is in accordance with regulations from the Ministry of the Environment on EE waste. The buyer is obliged to make it known to the carrier if damage or defect is demonstrated upon receipt of goods. Defective delivery must be reported in writing without undue delay, and no later than 6 days after receipt of the goods. The invoice number must be included.

    (3) Terms of Payment

    Payment terms are net per. 15 days. After the end of the payment period, default interest is calculated according to the Act on Interest in the Event of Late Payments. The buyer is obliged to pay the agreed purchase price in full upon the due date to SML Lighting even if the buyer has complained about the item.

    (4) Consumer Purchases

    All consumer orders must be paid in advance.

    (5) Special Lighting

    For special and made-to-order lighting, a separate agreement must be done. Such an agreement will be binding on the types and numbers offered.

    Products that are specially made after the customer’s specifications will be considered as Special Lighting.

    In the event of cancellation during the production phase, we reserve the right to demand payment for all work performed, both in terms of production and construction work prior to the start of production.

    For items ordered in accordance with the buyer’s order, cancellation is not accepted later than 3 weeks before confirmed delivery date. Any return of such goods will not be credited unless there is a special, written agreement. SML Lighting reserves the exclusive copyright to drawings, technical details, and other matters that are entrusted to the buyer in connection with offers / tenders and delivery of special lighting and specially adapted solutions.

    (6) Returns

    Returned items will not be accepted without a written agreement between the Buyer and SML Lighting. If a return is accepted, a reception fee of at least 20% of the invoiced net amount will be charged, with a minimum of NOK 1,000. Returned goods must appear unused, without damage and returned in original packaging, and marked with an invoice number. Returns are made at the buyer’s expense and risk. For luminaires agreed to be used for test suspension, the buyer is responsible for any damage. Credit is not given for returned special luminaires and luminaires modified at the buyer’s request. Returns of goods later than 6 months, or 4 months for LED products, after issuance of invoice will not be accepted.

    (7) Damage Complaints

    For our deliveries of goods, the Norwegian Purchase Act (Kjøpsloven) applies, unless otherwise agreed in writing. Complaints must be made immediately. The buyer is obliged to examine the item thoroughly upon receipt. Defects or deficiencies that should have been discovered during such an inspection cannot be claimed if the buyer has failed to inspect the item upon receiving it. Transport damage must be applied to the consignment note immediately. Immediately after the defect is discovered, the buyer must submit a complaint in writing to SML Lighting.

    (8) Liability

    SML Lighting’s liability is limited to damages that are a direct result of manufacturing defects. Faults or defects in equipment, which fall under SML Lighting’s responsibility and are within the warranty period, will be repaired or replaced with new equipment. Repairs and troubleshooting (troubleshooting is not normally covered) will only be reimbursed after written acceptance with SML Lighting. SML Lighting’s liability discontinues if the products are installed under different operating conditions than anticipated. Likewise, the supplier’s liability discontinues in the event of incorrect use and/or installation. Normal wear and tear or aging are not considered a defect. SML Lighting’s liability for defects in the delivered goods does not include secondary damage or loss. This only covers the item and not disassembly/assembly, shipping, or other costs. The customer is responsible for sending the defective equipment for repair.

    (9) Liability Beyond the Contract Amount for Defects or Delays

    SML Lighting is not responsible for consequential damages, losses or costs that may result from a delayed or defective delivery.

    SML Lighting also accepts no consequential liability for day fines, labor costs, damages, loss of income, or rent.

    (10) Specifications and Description

    SML Lighting reserves the right to change technical data, as well as the design of goods as they are presented in catalogs, brochures, images, drawings, or other forms of publications without prior notice.

    (11) Delays          

    SML Lighting is not responsible for delayed delivery when this is due to matters such as Force Majeure (defined as matters beyond the parties’ responsibility), strikes, or matters on the part of the carrier. The seller must notify the buyer of the delay and its duration as soon as possible. Delays for such reasons do not entitle the buyer to withdraw his orders, cancel delivery agreements and contracts, or make claims for compensation of any kind. 

    (12) Disputes

    Any disputes that arise between the parties shall be resolved through negotiations. If negotiations do not succeed, the dispute shall be settled in accordance with Norwegian Law at the seller’s venue in Sarpsborg, Norway

    (13) Sales Pledge

    SML Lighting has a sales lien on goods sold for the purchase price with the addition of interest and costs until the goods are paid in full.
